Why Delta-8 is Not on Amazon

Delta-8 is a niche hemp product that is recently making waves in the hemp industry. With so much demand for Delta-8 products, it’s surprising that a massive company like Amazon doesn’t stock these products. You can find anything on Amazon, right?

Amazon has particular rules around the types of products their retailers are allowed to sell. Delta-8 THC falls into one of these restricted categories. We’ll go over precisely what rules Delta 8 falls under according to Amazon’s reseller’s agreement and why they don’t allow it on their platform.

Amazon’s Product Policy

Amazon hasn’t gotten to where they are by playing fast and loose. Over the years, Amazon has marketed itself as a trustworthy brand with speedy shipping.

The product policy at Amazon indicates exactly what products are permitted and which ones are not. By keeping strict control over the products that make it onto the Amazon marketplace, they can make sure the brand they’ve built stays intact.

Amazon’s product policy includes categories such as:

  • Cosmetics & Skin Care

  • Electronics
  • And much more!
It makes sense that Amazon would have specific criteria around the sale of these products. If anyone got sick or injured using a product purchased on Amazon, it would degrade their reputation, cost them money in lawsuits, and potentially get them into trouble with the federal government.

Why Delta-8 THC is Restricted on Amazon

Because Amazon is so protective of its brand, many of these product restrictions could be considered overprotective.

For instance, laser pointers are not allowed on Amazon. While laser pointers are widely used and available, Amazon does not allow them in its marketplace.

This makes sense. While laser pointers are generally safe when used properly, they can also be harmful when misused. It just takes one kid pointing it at an airplane or into their eye to lead to massive problems for Amazon.

While hemp products and Delta-8 THC don’t pose the kind of risk that a laser pointer does, it still makes sense that Amazon wouldn’t allow these types of products on their site.

Marijuana is a controlled substance by the US federal government, and the federal government only recently approved the cultivation and sale of industrial hemp. The only thing that separates marijuana and industrial hemp is the Delta-9 THC content, and Amazon would have to rely on their sellers to be honest about that.

Amazon can’t test every Delta-8 THC gummy or CBD product that makes its way into its warehouse. Just one product with over 0.3% Delta-9 THC would be classified as marijuana instead of hemp, a misstep that could lead to massive problems for Amazon.

With the distribution network that Amazon has, they could be charged with massive federal crimes related to the sale and distribution of controlled substances. A scenario like this, in which the company was threatened by the FDA for compliance issues, actually happened quite recently.

Amazon’s Policy on Hemp

The exact policy that Amazon has spelled out is very broad and encapsulates many hemp-derived products.

Specifically, this policy can be found in Amazon’s section on drugs & drug paraphernalia. In the section titled “Drug products and ingredients,” subsection i. reads the following:

i. Listings for products containing cannabidiol (CBD) are prohibited, including but not limited to:

i. Full-spectrum hemp oil

ii. Rich hemp oil

iii. Products that have been identified as containing CBD by LegitScript

For this section, CBD is a “products category, " not a specific product.

Amazon will not allow the sale of any cannabinoid on their website, including CBG, CBN, Delta-9 THC, Delta-8 THC, and all the rest of them. This prevents anything other than hemp products without any cannabinoids from being sold. Hemp seed oil, hemp fiber, hemp-based lotions, and hemp clothing are all allowed by Amazon.

Will Amazon Sell Delta-8 Products?

It’s impossible to know for sure, but they likely will in the future. At this time, there are too many restrictions on the sale of industrial hemp for them to get involved. When the federal government starts to loosen restrictions, Amazon will likely want to be a part of this growing industry.

With so many small Delta 8 companies coming into existence, Amazon can’t keep up with all of them and their testing procedures. Many of these companies use “synthetic” Delta 8 THC, which could be illegal on its own.

Quick note: "Synthetic Delta 8 THC" is also called "converted Delta 8 THC." Instead of the Delta 8 THC being naturally extracted from the hemp plant, processors convert CBD into Delta 8 THC.
