THIS PROMOTION IS VALID ONLY IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING IDAHO, WASHINGTON, OREGON, COLORADO, CALIFORNIA, NEW YORK, FLORIDA AND RHODE ISLAND). VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW. THESE RULES REQUIRE YOU TO ARBITRATE ANY DISPUTES.

BY ENTERING OR OTHERWISE PARTICIPATING IN THIS PROMOTION, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. THIS CONTRACT REQUIRES YOU TO INDEMNIFY AND TO RELEASE ALL CLAIMS AGAINST THE PROMOTION ENTITIES (AS DEFINED BELOW).

1. NO PURCHASE NECESSARY

No purchase or payment is necessary to enter or win.

2. ELIGIBILITY

The LIVE HIGHER SWEEPSTAKES (“Sweepstakes”) is open only to legal residents of the 50 United States and the District of Columbia, excluding residents of Idaho, Washington, Oregon, Colorado, California, New York, Florida and Rhode Island, who are 21 years of age or older at the time of entry. Sponsor reserves the right to disqualify entries from states where participation or prize fulfillment is prohibited or restricted by law. Age verification is required for participation. Employees, officers, and directors of Sky Marketing Corporation, a Texas Corporation dba Hometown Hero (“Sponsor”), its affiliates, subsidiaries, advertising and promotion agencies, and each of their respective immediate family members (defined as spouse, parent, child, sibling, grandparent, and their respective spouses) and those living in the same household of each are not eligible to participate. Promotion is void in Puerto Rico and where prohibited. All federal, state, and local laws and regulations apply. By participating in the Promotion, entrants agree to be bound by these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. SWEEPSTAKES PERIOD

The Sweepstakes begins on May 22, 2025 and ends on July 22, 2025 (“Sweepstakes Period”).

● Weekly Small Prize Drawings: One (1) small prize winner will be selected each week beginning June 3, 2025 through July 8, 2025, for a total of 6 (six) drawings. To be eligible for each weekly drawing, entries must be received by 11:59 p.m. CT on the Sunday prior to each drawing date.

● Grand Prize Drawing: The grand prize winner will be selected on July 22, 2025. All entries must be received by 11:59 p.m. CT on Sunday July 20, 2025 to be eligible for the grand prize.

4. HOW TO ENTER

Eligible entrants may enter the Sweepstakes in the following ways:

● Online Purchase: Eligible entrants will receive entries based on the type of qualifying purchase made at Hometown Hero website during the Promotion Period:

○ One-Time Purchase: Earn one (1) entry for every $1 spent.

○ Subscription Purchase: Earn two (2) entries for every $1 spent. Purchases made during the Promotion Period prior to official sweepstakes entry may be eligible for entry credit upon formal opt-in and acceptance of these Official Rules, provided sufficient proof of purchase and account information are submitted. Entries are calculated based on the list price (excluding discounts, taxes, and shipping), and rounded up to the nearest whole dollar. Returned purchases will void associated entries. No limit on purchase entries.

● Email Sign-up: Entrants who are subscribed to receive email from Hometown Hero during the Promotion Period will receive twenty (20) entries. This includes both new sign-ups and existing subscribers. To be eligible, the email address must remain actively subscribed through the end of the Promotion Period. Entrants may only enter using one (1) email address and may only create or use one (1) account. Submitting multiple email addresses or signing up on behalf of others is strictly prohibited and may result in disqualification. Upon submitting an email address, new users will be prompted to create a password to finalize their Hometown Hero account, where they can view and track their entries. Entries are associated with the account linked to the submitted email address, which also serves as the primary means of communication regarding the sweepstakes.

● Referral Entry: Entrants who refer a friend through their unique referral link will receive twenty (20) entries for each new valid sign-up by the referred friend. No purchase required by either party.

5. ENTRY MULTIPLIERS

Throughout the Promotion Period, Sponsor may offer Entry Multiplier events (e.g., 2X, 5X, 10X, etc.). During these events, eligible online purchases and free entry actions (email sign-up, SMS sign-up, referrals) will receive multiplied entries as announced. Entry Multiplier offers will be communicated via [WEBSITE/SOCIAL MEDIA].

6. AGE VERIFICATION

Entrants must complete secure age verification confirming they are 21 or older. Valid government-issued ID may be required. Failure to verify age will disqualify the participant.

7. PRIZE DETAILS

● Weekly Small Prizes: A total of 6 winners will be selected across 6 weekly drawings. Upon being contacted by our team, verified, and notified of their win, each winner may choose one (1) prize from a curated set of 6 different options (each with an Approximate Retail Value [ARV] of $250). Each prize option may only be selected up to two (2) times total across all drawings. Once a prize has been selected twice, it will no longer be available for selection. At the conclusion of all 6 drawings, any unselected prizes will be void and not awarded. Verified winners can expect their selected prize to be shipped within six (6) weeks of verification.

● Grand Prize: One (1) winner will receive a trip anywhere in the lower 48, and a year’s supply of cannabis gummies created to their specifications in partnership with Hometown Hero (ARV: $7,000).

Grand Prize Description:

One (1) Grand Prize will be awarded, consisting of: (1) a domestic trip for the winner and one (1) guest within the contiguous United States; and (2) a year’s supply of custom-formulated hemp-derived gummies created in collaboration with Hometown Hero.

Trip Component:

Winner and one (1) guest will receive a domestic trip within the forty-eight (48) contiguous United States, for a duration of two (2) to four (4) nights, based on winner preference and subject to availability. The trip includes:

● Round-trip coach-class air transportation for two (2) from any location within the fifty (50) United States to any destination city within the forty-eight (48) contiguous United States, and standard hotel accommodations (one room, double occupancy) for two (2) to four (4) nights. All travel arrangements must be booked exclusively through Sponsor or Sponsor’s designated agent. The combined total value of airfare, hotel accommodations, applicable taxes, and any booking or administrative fees may not exceed $4,000 USD;

● One (1) cash award of $1,000 USD, to be fulfilled in the form of a check made payable to the confirmed winner.

Travel must be booked no later than December 31, 2025, through Sponsor or Sponsor’s designated agent. The winner’s travel companion must be at least twenty-one (21) years of age as of the date of travel. Additional restrictions, blackout dates, and advance notice requirements may apply. Any difference between actual travel cost and the allocated amount will not be awarded.

Custom Gummy Collaboration Component:

Winner will collaborate with Hometown Hero’s Product Development team to design the specifications of a custom batch of hemp-derived gummies. The collaboration includes:

● One (1) flavor iteration of custom gummies;

● A total of up to 365 gummies to be delivered over four (4) quarterly shipments;

● Each gummy may contain up to 25mg of Delta-9 THC, with a total THC cap of 9,000mg for the entire batch;

● If a higher potency per gummy is requested, the winner must select from one of Sponsor’s preexisting gummy molds and remain within the 9,000mg total Delta-9 THC limit;

● Gummies will be Farm Bill-compliant (<l0.3% Delta-9 THC) and must comply with the hemp laws and regulations of the winner’s state;

● Gummies will be delivered in food-safe packaging;

● The final recipe and formulation will remain the sole property of Hometown Hero.

Winner must be twenty-one (21) years of age or older to participate in the gummy formulation component. The Approximate Retail Value (“ARV”) of the gummy prize is $2,000 USD, based on the retail value of 365 of Sponsor’s 25mg Delta-9 THC gummies. No custom formulations will be permitted beyond what is allowed by applicable law. Prize delivery is subject to compliance with the recipient’s state laws regarding hemp-derived THC.

Sponsor reserves the right to substitute or withhold any prize component that cannot legally be delivered or consumed in the winner’s jurisdiction.

Total Approximate Retail Value ("ARV") of the Grand Prize: $7,000 USD. Actual value may vary depending on point of departure, travel preferences, market fluctuations, and winner’s selected gummy formulation. Any difference between actual value and stated ARV will not be awarded.

All federal, state, and local laws and regulations apply. Prize is non-transferable and may not be substituted except at Sponsor’s sole discretion.

All prizes include hemp-derived THC-infused products intended only for individuals age 21 or older. Proper age verification will be required upon prize delivery.

Additional Disclosures:

Winner will be solely responsible for any federal, state, and local taxes, and for all fees and expenses associated with prize acceptance and use not expressly specified as being provided by the Sponsor herein. The value of the prize is taxable as income, and if the winner is a legal resident of the United States or the District of Columbia, an IRS Form 1099 will be issued in the name of the winner for the total value of the prize as stated above.

Winner and guest must possess all required travel documents, including a valid government- issued photo ID or passport, as applicable.

8. WINNER SELECTION & NOTIFICATION

Winners are selected via random drawing from all eligible entries for the applicable period. All prizes are non-transferable or assigned and no substitutions or cash redemptions except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor will not replace any lost or stolen prizes. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.

Weekly prize winners are ineligible for additional small prizes but remain eligible for the grand prize. Winners will be notified by e-mail and must respond within 24 hours, otherwise, an alternate winner may be selected.

9. ODDS OF WINNING

Odds depend on the number of eligible entries received. All entry methods have equal odds.

10. GENERAL CONDITIONS

Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes if fraud or technical issues compromise the integrity of the promotion. Participation constitutes agreement to these Official Rules and the decisions of the Sponsor.

11. LIMITATION OF LIABILITY

By entering this sweepstakes, entrants waive all right to, and hold the Sponsor harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor is not responsible for any technical errors, delays, or damages resulting from participation or use of any prize.

12. CHOICE OF LAW AND FORUM

Entrant agrees that all matters arising out of or relating to this sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Texas, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this sweepstakes and these Official Rules shall be brought exclusively in the applicable federal or state courts located in Austin, Texas.

13. BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

Except where prohibited by law, as a condition of participating in this Sweepstakes, each entrant agrees as follows:

Binding Arbitration Agreement. Except as otherwise stated below, any and all legal issue, claim or dispute arising out of or connected or related in any way to the Sweepstakes, including but not limited to prize awarded, shall be resolved through final, binding arbitration. Participant specifically agrees that, except as otherwise provided herein, entry into the Sweepstakes waives all rights to bring a lawsuit based on such claim(s) or dispute(s) and the right to have such lawsuit resolved by a judge or a jury.

This Arbitration Agreement shall be governed by the Federal Arbitration Act, (9 U.S.C. § 1 et seq.). Any arbitration will be commenced and administered by JAMS under the rules of JAMS, including JAMS Consumer Arbitration Minimum Standards https://www.jamsadr.com/consumerminimum-standards/. If JAMS’ criteria are met by the nature of the dispute, the entrant agrees that the arbitration shall be conducted under JAMS Streamlined Arbitration Rules & Procedures https://www.jamsadr.com/rules-streamlined-arbitration/. Judgment upon any arbitration award may be entered in any court of appropriate jurisdiction.

Each party will pay the fees for his/her or its own attorneys, subject to any remedies to which that party may later be entitled under applicable law. However, if Participant is unable to pay JAMS’ costs, Sponsor will pay all arbitration fees and expenses. If JAMS is unavailable, unwilling, or otherwise unable to administer an arbitration in accordance with these rules, then another arbitration administrator will do, to be selected by agreement of the parties.

Neither entrant nor Sponsor shall be permitted to obtain awards, and all parties hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes). The parties further waive all rights to have damages multiplied or increased.

The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The award of the arbitrator is final and binding upon both you and us. Additionally, the arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, except that this sentence shall not apply to the Class Action Waiver provisions described below. The arbitrator will render a decision in writing. A court of competent jurisdiction shall have the authority to enter judgment upon the arbitrator's decision/award. This Arbitration Agreement will survive the termination of your relationship with us.

Excluded Disputes. Notwithstanding the binding arbitration requirement set forth in this section, entrant may bring qualifying claims in small claims court so long as the matter remains in such court and advances only on an individual, non-class, non-representative basis.

Class Action Waiver. To fullest extent permitted by applicable law, you and we agree to bring any claim or dispute, whether in arbitration, or court as permitted by these terms, ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION OR COLLECTIVE ACTION. There shall be no right or authority for any claim or dispute to be brought, heard or arbitrated as a class or collective action ("Class Action Waiver"). The arbitration will decide the rights and liabilities, if any, of you and us. The arbitration proceeding will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator may award any remedy to which a party is entitled under applicable law, but remedies shall be limited to those that would be available to a party in their individual capacity. Regardless of anything else in this Arbitration Agreement and/or the applicable JAMS rules, the interpretation, applicability, enforceability or formation of the Class Action Waiver may only be determined by a court and not an arbitrator. This Class-Action Waiver will survive the termination of your relationship with us.

One-Year Time Limit to Raise Disputes or Claims. You agree that any dispute, claim or lawsuit, regardless of form, that may arise out of or related to the Sweepstakes, must be filed within ONE (1) YEAR of the action, omission, event or occurrence giving rise to the dispute, claim(s) or lawsuit. After the expiration of the one-year period, such dispute, claim(s) or lawsuit will be time barred and prohibited, without regard to any longer period of time which may be provided by any period of limitation or pursuant to law or statute.

Waiver of Jury Trial. BOTH ENTRANT AND SPONSOR HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, except as provided herein. We are instead mutually electing that all disputes, claims, or requests for relief shall be resolved by arbitration under this Arbitration Agreement, except as specified herein. An arbitrator can award on an individual basis the same damages and relief as a court and must follow this Agreement as a court would. However, there is no judge or jury in arbitration, and court review of an arbitration award is subject to very limited review.

Location of Arbitration. Participant may choose to have the arbitration conducted by video conference technology such as zoom, or based on written submissions. Otherwise, the location of the arbitration proceeding shall take place in the city or state where entrant resides, unless each party to the arbitration agrees otherwise, or at another mutually agreed upon location.

14. SEVERABILITY

If any term of provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed and the remainder of these Official Rules shall continue in full force and effect.

15. PRIVACY

Personal data collected will be used only to administer the Sweepstakes and in accordance with Sponsor’s Privacy Policy at https://hometownhero.com/pages/privacy-policy/.

15. WINNERS LIST AND OFFICIAL RULES

The names of all prize winners will be posted on hometownhero.com after they have been verified. The Official Rules will be posted on hometownhero.com throughout the promotion.
