AN ACT

Allowing for industrial hemp in this Commonwealth. 

Section 2. Definitions.

“Industrial hemp.” A plant of the genus cannabis and any part of the plant, whether growing or not, containing a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry-weight basis. “Product.” A finished product containing industrial hemp which:

(1) Is a cosmetic, food, food additive or herb.

(2) Is for human use or consumption.

(3) Contains any part of the hemp plant, including naturally occurring cannabinoids, compounds, concentrates, extracts, isolates, resins or derivatives.

(4) Contains a delta-9 tetrahydrocannabinol concentration of not more than 0.3%.Section 3. Manufacturing of food products. Each manufacturer of food containing industrial hemp must comply with the following:

What’s Delta 9 THC?

There are over 113 different cannabinoids that can be extracted from the hemp plant. The  three most commonly desired include:

  • CBD
  • Delta 8-THC
  • Delta 9-THC

Delta 9 THC (Delta-9-tetrahydrocannabinol) is a cannabinoid found in both hemp and marijuana plants. It's a common misconception that hemp does not contain THC, or specifically Delta-9 THC. But there are actually many variations of THC and other cannabinoids located in hemp.

What’s the Difference Between Delta-8 and Delta-9?

Although Delta-8 and Delta-9 are both forms of THC, they both offer unique effects. Both have identical chemical formulas, but with a distinct difference in arrangement.

Delta 8 is an isomer of Delta 9. Delta 9 has what’s called a “double-bond” that can be found on its ninth carbon chain. Delta 8’s double-bond is found on its eighth carbon chain. It may seem like a small difference, but the location of the bond has a specific effect on your body. 

Delta 9-THC cannot be categorized as a form of marijuana unless it appears in a concentration more than 0.3% on a dry weight basis or is derived from a marijuana plant. 

What Are the Effects of Delta 9 THC?
