SB3: A Total Ban of THC in Texas

There's no pleasant way to say this—if SB3 passes in the 2025 Texas Legislature, it will ban all forms of hemp-derived THC in the Lone Star state. That means no more Delta-8 and Delta-9, along with tens of thousands of Texans losing their jobs. Although we've fought and won in the past, this time is different, but hope is not lost.

Senate Bill 3
On December 4, 2024, Lieutenant Governor Dan Patrick issued a statement in support of Senate Bill 3, which aims to outlaw all forms of hemp-derived THC in Texas. In it, he claimed that such products are "life-threatening," even though zero people per year die from THC, along with claiming that the bill would "keep these unsafe products off our streets," even though prohibition only creates black markets.
"It will come up, and it's pretty much a guarantee that it will pass in the Senate," Cabrera said. "This is Texas, which allegedly loves freedom and liberty, which is amazing because what they're talking about is wiping out the industry at the expense of thousands, tens of thousands of other companies, and definitely tens of thousands, over 50,000 employees in the state."
We Saw This Coming
Earlier this year, during the 2024 interim charges (a process that determines what the Texas House or Senate wants to address during the upcoming legislative session), we learned that Patrick made banning hemp-derived THC a significant priority.
What would remain in place is the state's Compassionate Use Program, which is so faulty and weak that it barely passes as a medical marijuana program. However, by eliminating the "competition," SB3 will dispose of thousands of jobs and enrich the license holders to the status of billionaires.
We Can't Do It Alone
SB3 isn't the first time prohibitionists, led by outdated misinformation or special interests, have tried to attack Texans' access to THC. In 2021, it was HB 3948, followed by the DSHS declaring Delta-8 to be legal (despite being a state agency, not an elected legislative body), and in 2023, it was SB264.
However, this time is different.
Although the hemp industry has grown, so have its enemies in number and strength. During the last few attempts, Hometown Hero has led the defense of this industry in Texas and won. However, we currently need more resources to fight SB3.
